Product and Service Liability Waiver
WAIVER AND ASSUMPTION OF RISK
I, ________________________________________, Customer, voluntarily sign this Waiver and Assumption of Risk in favor of the Owner, Cindy Feltman Angulo of Flex Ex Solutions LLC and The Edge Fitness Institute LLC, in consideration for the opportunity to use parks, gyms (Village Health Clubs), in-homes or the Owner's facilities (16742 E Trevino Dr Fountain Hills, AZ 85268 ) and/or the opportunity to receive instruction from the Owner (Cindy Angulo) or the Owner's employees, and/or to engage in the activities sponsored by the Owner, as follows:
*Risk of injury or death to Customer from Customer's use of the FX BOOM FITNESS SYSTEM INCLUDING BELT, SHOULDER STRAPS, FOOT STRAPS, MINIBANDS, AND SAFETY TONER BANDS), Perform Better Bands (or Sheathed Bands Recommended), the 3D STRENGTH RIGS, TRAXX TRAINERS, or any equipment (TRX, STEPS, BANDS, YOGA TRAPEZE, BALANCE TOOLS used in addition to any of the FX BOOM FITNESS products.)
*Damage or loss to building structures, facilities, fitness equipment directly or indirectly caused by the attachment of FX BOOM FITNESS SYSTEM products to said structures or facilities during Customer's use.
*Customer must ACKNOWLEDGE WAIVER, REPORT ANY MEDICAL LIMITATIONS WITH HEALTH HISTORY REPORT AND GET PHYSICIANS APPROVAL IF NEEDED, and RECEIVE GUIDANCE by a trained professional in the FX BOOM FITNESS SYSTEM Product Line and Methodology prior to and during use.
*Customer acknowledges FX BOOM FITNESS Workout Design and Methodology is not medically or scientifically proven by medial physicians. Customer must discuss the use of the FX BOOM FITNESS SYSTEM BELT, SHOULDER STRAPS, FOOT STRAPS, MINIBANDS, AND SAFETY TONERS, 3D STRENGTH RIG, TRAXX TRAINER, or Perform Better Bands or any equipment (TRX, STEPS, BANDS, YOGA TRAPEZE, BALANCE TOOLS used in addition to any of the FX BOOM FITNESS products.) with a medical professional before Customer's initial use.
*Flex Ex Solutions does not guarantee results from the use of this product.
Customer understands that there are certain risks and dangers associated with the activity and use of the facilities and that these risks have been fully explained to me. Customer understands the danger involved.
Customer fully assumes the risks involved as acceptable and agrees to use the best judgment in undertaking these activities and follow all safety instructions.
Customer waives and releases the Owner from any claim for personal injury, property damage, or death that may arise from my use of the facilities or from my participation in the activities or instruction.
As an Addendum to the Waiver you have previously signed with us as a member, you agree and understand the following:
By entering a facility or park, you are aware that you agree to fully accept all known and unknown risks, including the potential risk of exposure to respiratory illnesses such as the coronavirus (COVID-19). The coronavirus is primarily transmitted via exhaled respiratory droplets, most often through coughing and sneezing. These droplets can travel up to six feet and are more commonly transmitted between persons rather than from equipment to persons.
Although we regularly sanitize our equipment and presently are using enhanced cleaning methods and enforcing social distancing in our facility, you understand that you may be exposed to the coronavirus or its symptoms through no fault of our own. Known coronavirus symptoms include fever, coughing, shortness of breath, pneumonia, kidney failure, and may include other symptoms, stroke or even death (collectively "Symptoms"). You understand and agree that you will hold us harmless and you will not hold us liable for any real or perceived Symptoms of COVID-19 or any other disease, illness, or condition, nor for exacerbating any existing symptoms, and you fully agree to accept all risks of entering the facility, using the equipment, working with personal trainers, attending classes, and/or interacting or being exposed to other members.
